Legal Notice: This document contains the Standard Terms and Conditions of business for Quick-Shift Removals. It details our respective obligations, limitations of liability, and the structure of our Goods in Transit insurance offering. Customers are advised to read this document carefully prior to confirming a booking.
Terms and Conditions of Service
1. Interpretation and Definitions
- “We“, “Us“, “Our” refers to Quick-Shift Removals, its employees, subcontractors, and authorized agents.
- “You“, “Your“, “Customer” refers to the individual or entity booking the services.
- “Goods” means all items, furniture, and belongings entrusted to us for removal, packing, storage, or transit.
- “Services” refers to all activities undertaken by us in connection with the removal, packing, unpacking, and
transport of Goods. - “PBO” (Packed by Owner) means goods packed into cartons, bags, or containers by you, not by our staff.
2. Quotations and Pricing
- Validity: Quotations are valid for 28 days from the date of issue. We reserve the right to amend the quotation if a booking is not confirmed within this period.
- Basis of Quote: Unless explicitly stated as a “Fixed Price Quote,” all quotations are estimates based on an
hourly rate. The final invoice will be determined by the actual time taken to complete the Services from the time we depart our depot until we complete the delivery. - Additional Charges: We may apply additional charges if:
(a) The volume of Goods exceeds the original description provided;
(b) Access to either the pickup or delivery property is restricted (e.g., stairs, long walks, inability to park the removal vehicle within 20 meters of the doorway) and was not disclosed;
(c) Delays occur due to circumstances outside our control (e.g., waiting for keys, previous owners vacating, severe weather).
3. Services Excluded from Standard Quotation
Unless expressly agreed in writing, our standard Services do not include:
- Dismantling or assembling complex flat-pack furniture, sheds, or outdoor equipment.
- Disconnecting or reconnecting appliances, plumbing, or electrical equipment.
- Removing or installing doors, windows, or fittings to facilitate the movement of Goods.
- Hoisting Goods over balconies or through windows.
4. Customer Obligations
To facilitate a safe and efficient removal, You agree to:
- Presence: Ensure you or an authorized representative is present throughout the collection and delivery of the Goods. We accept no responsibility for Goods left unattended at unoccupied premises.
- Adequate Packing: Ensure all PBO Goods are adequately packed in sturdy, purpose-built moving cartons, securely taped shut. We reserve the right to refuse transport of poorly packed items.
- Dangerous Goods: Do not submit any items for transport that are dangerous, corrosive, highly flammable, explosive, or illegal. This includes gas cylinders, firearms, ammunition, fuels, poisons, and toxic plants.
- Valuables: Retain personal custody of highly valuable items, including cash, jewelry, precious metals, important documents, deeds, and electronic data. We accept no liability for the loss of such items.
- Preparation: Defrost refrigerators and freezers, and empty washing machines of all water prior to our arrival.
5. Payment Terms and Lien
- Deposit: A non-refundable deposit is required to secure your booking date.
- Payment of Balance: The remaining balance of all charges must be paid in full upon completion of the
unloading at the destination address, prior to our staff departing the site. We accept credit card, debit card, or cleared EFT payments. - Right of Lien: Under common law and these terms, we reserve the right of lien (a legal right to hold your
Goods) in the event of non-payment. If your account remains in arrears, we may place your Goods into storage at your expense. Ultimately, if payment is not made within 28 days of a formal demand, we may sell the Goods to recover the outstanding debt, storage costs, and administrative fees.
6. Cancellation and Postponement
If you cancel or postpone your booking within 48 hours of the scheduled start time, your deposit will be forfeit to cover administrative costs and lost allocation of resources. Rescheduling with more than 48 hours’ notice will incur no penalty, subject to availability
7. Liability and Consumer Guarantees

- Australian Consumer Law: Our Services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage resulting from our negligence
- Exclusions of Liability: Subject to the ACL, Quick-Shift Removals will not be liable for:
(a) Packed by Owner (PBO) Goods: Damage to the contents of cartons packed by you, unless there is visible, severe damage to the exterior of the carton caused by our handling.
(b) Pre-existing Damage: Any damage that was present prior to the commencement of the Services (including inherent defects or structural weakness of furniture, e.g., IKEA or particleboard furniture).
(c) Mechanical Derangement: The internal failure of electrical, mechanical, or electronic items (such as
computers, televisions, and refrigerators) where there is no outward sign of physical damage caused by us.
(d) Consequential Loss: Any indirect losses, such as loss of income, loss of market, or temporary accommodation expenses. - Notification of Claim: Any claim for damage must be reported to us in writing within three (3) days of the delivery of the Goods, supported by photographic evidence.
